This agreement is between Badgerland Irrigation and Lighting Service, LLC, the contractor, and the customer, hereinafter referred to as “you.”
Guarantee: All work is to be completed in a workmanlike manner according to standard industry practices. All agreements are contingent upon strikes, accidents, weather, product availability, pandemics, acts of God/war or delays beyond our control. This is a non-refundable and non-transferable agreement. By signing the attached Service Contract, you agree to the services and the terms and conditions outlined in this service agreement. It is mutually agreed that this agreement will apply to all further work that is requested and/or authorized by you and performed by the contractor.
Access to Customer’s Premises: You hereby grant the Contractor or any authorized agent permission to enter your premises at reasonable hours to install, repair, or service the irrigation system with prior knowledge as scheduled. If access to all necessary parts of the system for the scheduled service visit are not readily available to the service technician, you agree to pay an additional $75 for a return service call. The $75 charge must be paid before the return service call is scheduled.
Scheduling: It is our policy to schedule by neighborhood. However, if you have any special scheduling requests, please make note of those on the Service Contract form. Otherwise, we will pre-schedule based on geographic area. The contractor will make 2 attempts to contact you via telephone and/or email to advise you of the date and time you are scheduled. We must receive confirmation from you before we arrive to perform services. You can confirm via telephone, text, or email.
We know that your time is valuable; to provide you with the most expedited appointments, at the time of the writing of this contract, we schedule M-Th using a 4-hour arrival time window (ex. Your appointment is for 8am. That means our tech will arrive between 8am-12pm) Because we are unable to account for any repairs or issues our technicians may encounter at a service prior to yours, the time window best allows for planning for both parties. You will receive a reminder email, text, and or call the day before your appointment, and for your convenience you will receive an email, call, and/or text when the technician is on their way to your property. If a more specific time is required, our first appointments of the day have a 1-hour arrival window. Friday appointments for “Program Services” are available at an additional fee based on location. Please note first of the day and Friday appointments are limited in their availability.
Please note: Technicians will wait a total of 15 minutes from the time that they arrive at the appointment location, within the scheduled 4-hour window. If within those 15 minutes, access to the system is not made available, the technician will move on, and it will be considered a missed appointment. All missed appointments will be assessed with a fee of $75 which must be paid before the appointment is rescheduled.
The contractor will not contact you to schedule unless a signed contract has been received indicating your desire to have services contracted.
The contractor is not responsible if services are unable to be scheduled and completed due to customer unavailability or incorrect/ incomplete contact information provided by customer.
Payment: You are responsible for the prompt payment of invoices, which are due at the time of service. Invoices 15 days past due will be assessed at a 1.5% per month service charge on any unpaid balance. If you select email as your delivery method for invoices, please be sure to exclude info@badgerlandirrigation.com from your spam filters. You agree to pay all associated collection fees for unpaid balances greater than 60 days, including a reasonable fee for a collection agency or attorney.
Failure to be home for a scheduled and confirmed appointment will result in a missed appointment fee of $75 unless cancelled at least 24 hours prior to the scheduled appointment. The $75 charge must be paid before the service call is rescheduled.
Unfortunately, we are unable to provide any services to customers who have a balance beyond 60 days past due until the account is brought current.
Pricing: The prices agreed upon with your annual service contract do not include parts and additional labor. The prices included in your service contract are for the technician's visit and described services only. Any parts and additional labor will be billed separately according to cost. If you wish to walk through your system with the technician, please inform them prior to beginning work on your property. Additional time beyond what is allocated for your scheduled service will be billed out at our current hourly rate.
System flagging will be billed at a flat rate of $7 per zone, with a minimum charge of $28.
All early discount service agreements must be signed and returned by May 1, 2024, to receive our non-discounted bundled service contract prices, agreements received after May 1, 2024, will be charged our individual service pricing which is approximately 25% higher per service than our prepayment pricing, no exceptions.
No refunds will be given for services contracted and prepaid for which you later decide not to have completed. Additionally, if we are unable to get in contact with you to schedule the scheduled services in a timely manner, or if you have an open balance beyond 60 days past due, there will be no refunds given and no prepaid or contracted services will be performed.
Irrigation Repairs: Should you have a problem with a repair we have made to your irrigation system, we must be notified within 7 days of completion of the repair. When we leave a job site, the repair is deemed to be satisfactory. If a problem should arise afterwards, it is the homeowner’s responsibility to monitor their system and report any problems to us within the 7-day time period. You agree to have the contractor perform all repairs to the irrigation for the duration of the service year. If, while under contract, we arrive on site to find that contract work has been performed by others, you will be billed a $95 trip charge, and we will be unable to warranty any work performed.
Emergency, same day services are available for an additional “Emergency Trip Charge”; however, a credit card must be used to hold the deposit and payment for emergency services will be due upon completion of the service. When requesting Emergency Service, you will be notified by the dispatcher or technician that the Emergency Trip Charge will be applied. Our Emergency Trip charge is a fee of $195 plus travel time (billed at $125/hr.) which will be added to your bill in addition to the cost of any repairs. Payment for Emergency Services is due upon completion of service and a Deposit of $195 plus the estimated one-way travel time is due before the technician is dispatched.
Limitation of Liability: In no event shall the contractor have any liability for special indirect, incidental, or consequential damages arising out of any work or materials furnished in connection with offered services, including, but not limited to damage to your lawn, shrubs, and/or landscaping. The contractor shall not be responsible for damage to any water, electrical, cable television, gas lines, or any other homeowner owned object unless flagged to contractor’s satisfaction prior to the commencement of work. Prior to the commencement of any work, you or your representative shall notify the contractor of all underground conditions which would be damaged during the installation or repair of the system. The contractor shall not be responsible for any damage to any underground condition which the contractor was not made aware of prior to the start of the work or was not properly identified by you or your representative.
If you choose to turn the water to your system on yourself, the contractor is not responsible for any issues that may arise. To turn the water on yourself, you must reinstall the plug, turn the water on, and then verify that there are no leaks at the water out.
Contractor shall not be responsible for any damage to the irrigation system if they are not authorized to winterize the system in a timely fashion, in the event of freezing temps, or if the system is winterized by someone other than the contractor, including the owner or occupant. If the contractor winterizes your system, steps are taken to reduce the potential of damage due to leaking valves or human error. No freeze damage warranties are in effect against: (a) damaged shut off valve leaking water back into the system, (b) if someone other than the contractor turns on the system or shut off valve is turned on after the winterization and prior to the re-opening of the valve in the spring by the contractor, (c) damage to system due to exterior influences or acts of nature, (d) improper system design preventing contractor from draining back the system, or (e)The contractor is not and will not be responsible for any damages to the system due to freezing.
Contractor shall not be responsible for any damages caused to the system or work performed by the contractor because of the elements, acts of God, acts of third parties, including the owner or occupant or any other damages resulting from actions beyond the contractor’s control, to include acts of terrorism, government mandates or shutdowns, global pandemics, or war.
The contractor is NOT responsible for damages due to inclement weather, neglect, or misuse of your system.
Contractor shall not be responsible for any tree root damage, damage caused to other parts of the existing landscaping, or other items on the property that may need to be moved or disturbed to repair the system.
By requesting service, you agree to the terms and conditions provided in this Service Agreement. You agree to pay the full cost of the services contracted. Prepaid services are not refundable or transferable. If any part of this contract is deemed to be invalid the remainder of the agreement will stand as it is written.
